By registering on this site, submitting your order, and accessing and using our Services, you are acknowledging electronic receipt of and your agreement to the Terms. If 20/20 Credit determines that your use of the site is in a manner that is inconsistent with these terms and conditions, 20/20 Credit may terminate your access or block your future access as a violation of the Terms.
We may modify these Terms or any additional terms that apply to a particular service at any time. Changes will be effective immediately upon posting to this page. You agree to the terms as modified, upon your continued use of the Services following any modification to these Terms.
In order to purchase services from 20/20 Credit, you must complete the registration process and open an account. You will also be required to provide valid credit card information. You may register to purchase Services from 20/20 Credit only on behalf of yourself and by doing so, you acknowledge and agree that it is illegal to obtain credit information about anyone else without proper authorization. By registering, you further certify that all information provided by you during the registration process is true, accurate, complete and up to date. You further agree to abide by these Terms during your use of the Services, including any specific terms and conditions relating to particular services that you purchase and/or those terms and condition set forth in your Credit Repair Services Agreement. We provide the Services and related information to assist you in correcting inaccurate credit information that may be on your credit report, to monitor your credit report, and to obtain your credit report and score. You agree that you will not use the Services for any other purpose. You agree that you will keep your user ID and password strictly confidential and not share them with others.
Registering for an account is optional, but if you elect not to register for an account, you will not be able to access certain features of the Services.
You may only register for an account if you are eighteen years of age or older and have a valid U.S. Social Security Number. By registering, you certify that you meet these criteria.
All information you provide to us about yourself and your third party financial accounts must be true, accurate, current and complete information. You are required to keep all information up to date and accurate. You agree not to misrepresent your identity, your personal information or your third-party account information. By registering for an account or using the Services, you accept all responsibility for maintaining the confidentiality of your password, controlling and limiting access to your account, and for all activities that occur under your account or password. You may not sell, transfer or assign your account.
We may suspend or terminate your account or your use of the Services or otherwise deny you access to the Services at any time without notice and for any reason, including, without limitation, if we suspect that information you have provided is untrue, inaccurate, not current, or incomplete. You agree that we will not be liable to you or any third party if we suspend or terminate your access to any Services for any reason. We retain sole ownership over your 20/20 Credit account information.
Fees and Charges
If you purchase credit repair services, you agree to pay the fees and charges detailed in your Credit Repair Services Agreement. By placing an order for the Services, you authorize 20/20 Credit to charge your credit card or other account that you have designated for the payment of such fees and charges. In the event your credit card or other account is no longer valid, you agree to notify 20/20 Credit immediately and provide a new account through which you will make your applicable payments.
Cancellation of Your Account
You may cancel your account at any time. Upon cancellation, Services will be discontinued and you will be responsible for charges associated with any changes or removals that occurred within the last billing period prior to cancellation.
Free Credit Report and Score Access
After you receive your first free credit report, score, and analysis, if you do not purchase 20/20 Credit’s credit repair service, you will not be eligible for another free credit report, score, and analysis for at least 90 days after the date that you received the prior free credit report, score, and analysis. If you do not purchase 20/20 Credit’s credit repair service after receiving your free credit report, score, and analysis, access to your free credit report and score through our secure Member Center will be deactivated 30 days from the date that you received your prior free credit report, score, and analysis.
If you purchase 20/20 Credit’s credit repair service after receiving your free credit report, score, and analysis, you will continue to have access to your free credit report and score as long as do not cancel our credit monitoring service. If you cancel our credit monitoring service your access to your credit report and score will be deactivated on the date of your cancellation of credit monitoring.
Consent You Grant by Registering and Using the Services
When you register for an account with us, you are providing 20/20 Credit the following specific consent:
- I understand that I am providing written consent and instructions in accordance with the Fair Credit Reporting Act, Credit Repair Organization Act and other applicable law for 20/20 Credit to request and receive information about me from third parties, including but not limited to a copy of my consumer credit report and credit score, credit monitoring, and updates regarding my credit accounts from consumer reporting agencies, at any time for so long as I have an active 20/20 Credit account.
- I further understand that I am authorizing 20/20 Credit to retain a copy of all such information received, including the information I am submitting through this registration form or that I provide to 20/20 Credit from time to time, either directly or indirectly, and that such information may be used to identify product and services offers from 20/20 Credit’s marketing partners.
Free Annual Credit Report
You are entitled by law to receive one free credit report from each of the national credit reporting agencies (Experian, Equifax, and TransUnion) during any twelve-month period.
For more information on obtaining your free annual credit report from the national credit reporting agencies, visit www.annualcreditreport.com or the Consumer Financial Protection Bureau.
Restrictions of Use and Notice of Prosecution
Your use of the Services must comply with all applicable law. Unauthorized use of the Services, including but not limited to, unauthorized entry into 20/20 Credit’s systems, misuse of passwords, or misuse of any information available through Services, is strictly prohibited. Any person attempting to access any of the Services without authorization may be subject to prosecution.
Further, any person who obtains a consumer credit report or credit score or other consumer credit information under false pretenses or otherwise in violation of the Fair Credit Reporting Act or any applicable state or federal law may be subject to civil action or criminal prosecution.
Location of Services and Territorial Restrictions
You are not permitted to access or use the Services in any jurisdiction or country where your access or use would be in violation of the applicable laws or regulations of that jurisdiction or which would subject 20/20 Credit to the laws of such jurisdiction or any registration or licensing requirement of such jurisdiction. We control and operate the Services from the United States and we make no representations or warranties that the information, products or services provided through the Services are appropriate for access or use in other jurisdictions.
We reserve the right to limit the availability of the Services to any person, geographic area, or jurisdiction, at any time and in our sole discretion.
Links to Third Party Sites or Applications
Updates to Downloadable Items
If you install applications or other downloadable items that may be available via the Services, you consent to the download of, and updates to, software to your computer or mobile device and you accept the Terms in effect and any additional terms related to such application or downloadable item which shall be incorporated fully into the Terms.
We hold or license all necessary intellectual property rights pertaining to the content and materials used in the Services, including, without limitation, the copyright to all such content and materials. We also hold the trademarks or service marks to company, product, and service names and logos used and displayed on the Services, including, without limitation, 20/20 Credit (including the 20/20 Credit logo), 2020Credit.com, and all related logos (all such trademarks or service marks, the "20/20 Credit Trademarks"). The content and materials described above and the 20/20 Credit Trademarks are protected by U.S. intellectual property laws. You are permitted to use the content and materials only in connection with your use of the Services and you may not copy, reproduce, distribute, republish, display, post or transmit in any form (including, without limitation, linking to or mirroring) such content or materials or 20/20 Credit Trademarks without our express prior written consent. All content and materials and the 20/20 Credit Trademarks are and will remain the property of 20/20 Credit. You may not modify, sell, transfer or create derivative works based on any 20/20 Credit content or materials or the 20/20 Credit Trademarks, in whole or in part. You may not reverse engineer or reverse compile any of our Services or the Services' technologies.
You may not use the Services in any manner that infringes the rights of any third party. If you believe, in good faith, that any content or materials used by 20/20 Credit infringes your copyrights, notice of claimed copyright infringement should be sent to our legal department at firstname.lastname@example.org or by regular mail at 20/20 Credit, P.O. Box 671688, Marietta, Georgia 30006, Attention: Compliance Department. In connection with any such claim, we reserve the right to request additional information before we remove any infringing material.
Warranties and Disclaimers
USE OF THE SERVICES AND ANY MATERIALS OBTAINED THROUGH YOUR USE OF THE SERVICES IS AT YOUR OWN RISK. 20/20 CREDIT MAY DISCONTINUE OR MAKE CHANGES IN THE SERVICES AT ANY TIME WITHOUT PRIOR NOTICE TO YOU AND WITHOUT ANY LIABILITY TO YOU OR ANY THIRD PARTY. NEITHER 20/20 CREDIT NOR ANY OF OUR AFFILIATES, REPRESENTATIVES, AGENTS, OR SERVICE PROVIDERS, NOR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, MEMBERS, SHAREHOLDERS, EMPLOYEES, AGENTS, VENDORS, INDEPENDENT CONTRACTORS, LICENSORS OR REPRESENTATIVES (COLLECTIVELY, THE "20/20 CREDIT PARTIES") UNDERTAKE ANY OBLIGATION OR RESPONSIBILITY TO UPDATE OR AMEND ANY CONTENT OR OTHER INFORMATION PUBLISHED THROUGH THE SERVICES.
WE PROVIDE THE SERVICES AND CONTENT "AS IS," "AS AVAILABLE" AND "WITH ALL FAULTS," AND THE 20/20 CREDIT PARTIES MAKE NO WARRANTIES ABOUT THE RELIABILITY, ACCURACY OR USEFULNESS OF THE SERVICES OR SECURITY ASSOCIATED WITH THE TRANSMISSION OF INFORMATION TRANSMITTED TO OR FROM 20/20 CREDIT OR VIA THE SERVICES. THE 20/20 CREDIT PARTIES FURTHER MAKE NO REPRESENTATIONS, WARRANTIES OR ENDORSEMENTS THAT: (i) THE SERVICES WILL MEET YOUR REQUIREMENTS; (ii) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (iii) THE QUALITY OF ANY OF THE SERVICES, THE INFORMATION OR OTHER MATERIAL OBTAINED BY YOU THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS; OR (iv) ANY ERRORS IN TECHNOLOGY WILL BE CORRECTED.
FURTHER, THE 20/20 CREDIT PARTIES DISCLAIM ALL OTHER WARRANTIES RELATING TO THE SERVICES OR THE CONTENT, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON- INFRINGEMENT, EXCEPT TO THE EXTENT SUCH WARRANTIES ARE REQUIRED BY APPLICABLE LAW.
YOU ACKNOWLEDGE THAT 20/20 CREDIT IS SOLELY AN INTERMEDIARY BETWEEN YOU AND THE NATIONAL CREDIT REPORTING AGENCY OR OTHER INFORMATION PROVIDERS ACTUALLY FURNISHING YOUR CREDIT REPORTS, CREDIT SCORES, CREDIT MONITORING, AND OTHER INFORMATION. YOU ACKNOWLEDGE THAT THE NATIONAL CREDIT REPORTING AGENCIES MAINTAIN THE INFORMATION IN YOUR CREDIT REPORTS SUBJECT TO THEIR OWN INTERNAL OPERATING PROCEDURES AND APPLICABLE LAW AND THAT 20/20 CREDIT CANNOT GUARANTEE ANY SPECIFIC RESULTS. THE 20/20 CREDIT PARTIES EXPRESSLY DISCLAIM ANY LIABILITY FOR ANY ERRORS OR OMISSIONS IN THE CONTENT OR THE SERVICES, INCLUDING, WITHOUT LIMITATION, THE INACCURACY OR INCOMPLETENESS OF ANY SUCH CREDIT REPORTS, CREDIT SCORES, ANALYSIS OF RELATED INFORMATION, OTHER INFORMATION, TOOLS OR ANALYSES AVAILABLE THROUGH THE SERVICES OR ANY TECHNICAL INACCURACIES OR TYPOGRAPHICAL ERRORS.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THE 20/20 CREDIT PARTIES WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
NOTWITHSTANDING THE FOREGOING, NOTHING IN THIS SECTION SHALL AFFECT WARRANTIES WHICH MAY NOT BE WAIVED OR RESTRICTED UNDER APPLICABLE LAW.
Limitation of Liability
UNDER NO CIRCUMSTANCES WILL THE 20/20 CREDIT PARTIES BE LIABLE FOR ANY LOSS OR DAMAGES INCLUDING, WITHOUT LIMITATION, GENERAL, SPECIAL, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR ANY OTHER DAMAGES (SUCH AS LOSS OF PROFITS, LOSS OF GOODWILL, LOSS OF USE, LOSS OF DATA, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES) OF ANY KIND WHETHER IN AN ACTION IN CONTRACT OR TORT, EVEN IF THE 20/20 CREDIT PARTIES, OR REPRESENTATIVES THEREOF, ARE OR WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, LOSSES OR EXPENSES, ARISING OUT OF OR RELATING IN ANY WAY TO: (A) ANY PARTY’S USE OR INABILITY TO USE THE SERVICES OR ANY THIRD-PARTY SITE TO WHICH THE SERVICES LINK; (B) ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS OR LINE OR SYSTEM FAILURE; (C) THE COST OF GETTING SUBSTITUTE GOODS OR SERVICES; (D) ANY PRODUCTS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO, THROUGH OR FROM THE SERVICES; (E) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (F) STATEMENTS OR CONDUCT OF ANYONE ON THE SERVICES; (G) THE USE, INABILITY TO USE, UNAUTHORIZED USE, PERFORMANCE OR NON-PERFORMANCE OF ANY THIRD PARTY SITE; OR (H) ANY OTHER MATTER ARISING OUT OF OR RELATING IN ANY WAY TO THE SERVICES. THE 20/20 CREDIT PARTIES ARE NOT LIABLE FOR ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF ANY USER.
YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SERVICES IS TO DISCONTINUE USING THE SERVICES AND, IF YOU HAVE REGISTERED FOR ANY SERVICES THAT REQUIRE REGISTRATION, TO TERMINATE YOUR ACCOUNT.
IN NO EVENT WILL THE 20/20 CREDIT PARTIES’ TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES OR CAUSES OF ACTION OF ANY KIND OR NATURE WHATSOEVER EXCEED THE TOTAL AMOUNT PAID BY YOU TO 20/20 CREDIT.
Waiver of Unknown Claims
BY ACCESSING THE SERVICES, YOU UNDERSTAND THAT YOU MAY BE WAIVING RIGHTS WITH RESPECT TO CLAIMS THAT ARE AT THIS TIME UNKNOWN OR UNSUSPECTED, AND IN ACCORDANCE WITH SUCH WAIVER, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND, AND HEREBY EXPRESSLY WAIVE, THE BENEFITS OF SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA, WHICH PROVIDES AS FOLLOWS: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR," AND, TO THE EXTENT APPLICABLE, CORRESPONDING RIGHTS UNDER ANY SIMILAR LAW OF ANY STATE.
IF ANY OF THE FOREGOING LIMITATIONS ARE FOUND TO BE INVALID, THE 20/20 CREDIT PARTIES' TOTAL LIABILITY FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION OF ANY KIND OR NATURE WHATSOEVER SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW.
Monitoring of the Services and Disclosure for Administrative or Legal Reasons
You agree that 20/20 Credit shall be entitled to monitor the Services and your use of the Services electronically. We may access, use, preserve, transfer and disclose any information (including personal information) to: (i) satisfy any applicable law, regulation, subpoena, governmental request or legal process if in our good faith opinion such action is required or permitted by law; (ii) enforce these Terms, including investigation of potential violations thereof; (iii) protect the safety, rights, property or security of our Services or equipment or any third party; or (iv) detect, prevent or otherwise address fraud, security or technical issues. Any such access, use, preservation, transfer or disclosure may be carried out without notice to you at any time.
Governing Law and Dispute Resolution
The laws of the State of Georgia, excluding the conflicts of law provisions thereof, will apply to any disputes arising out of or in any way related to these Terms or the Services. All claims arising out of or in any way related to these terms or the Services will be litigated exclusively in a federal or state court of competent jurisdiction in Atlanta, Georgia, and you and 20/20 Credit submit to personal jurisdiction in those courts.
NO CLASS ACTIONS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION YOU MAKE AGAINST 20/20 CREDIT OR THE 20/20 CREDIT PARTIES ARISING OUT OF, IN CONNECTION WITH OR IN ANY WAY RELATED TO THE SERVICES WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION.
These terms, as may be amended from time to time, are effective until your account, if applicable, is deactivated by either you or 20/20 Credit.
You may deactivate your account by contacting 20/20 Credit at 844-780-2140.
Any section of the Terms that by its nature is intended to survive termination of this Agreement or your use or access to the Services shall survive such termination.
You agree to defend (if requested by the 20/20 Credit Parties), indemnify and hold harmless the 20/20 Credit Parties from and against any and all claims, losses, expenses, demands or liabilities, including attorneys' fees and costs, incurred by the 20/20 Credit Parties in connection with any claim by a third party arising out of or in any way related to: (A) your use of the Services; (B) your violation or alleged violation of the Terms, including, without limitation, your violation or alleged violation of any applicable law; or (C) your infringement or alleged infringement of any intellectual property or other right of any other person or entity. You shall not in any event settle any such claim or matter without the prior written consent of 20/20 Credit. The 20/20 Credit Parties reserve the right, at their own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you further agree that you will cooperate fully in the defense of any such claims.
